Design-around

Where a conflict exists, we propose an alternative structure or mechanism that meets the same functional need without importing the protected feature. This is the same refinement discipline we apply to every development.

Documentation

We keep the review record so the buyer has evidence of the diligence performed, which is what a retailer or a customs authority will eventually ask for.

What a buyer should never assume

  • That a low price means a clean design. It usually means the risk was not priced at all.
  • That a similar product already on the market is safe to copy. It may carry a licence you do not have.
  • That appearance alone determines infringement. Mechanism and function are where patents usually sit.

When a licence is the right answer

Some features are worth licensing rather than designing around, and we will say so. If a buyer already holds a licence, or if a feature is central to the product and a licence is available, building on that licence is faster and safer than an uncertain design-around. The point of the review is to give the buyer a clear choice, not to push every product toward a clean-sheet design.

We provide the review record, the design-around notes where used, and the specification as built. This file supports the buyer’s own compliance position with retailers and with customs, and it is the evidence a brand needs if a question is ever raised after launch.

How the review fits the project timeline

Patent review is placed before sampling, not after, because that is when it is free. A concept cleared on paper costs nothing; a concept cleared after tooling has been paid for costs the tooling. We return a written position alongside the first specification so the buyer can proceed, adapt or change concept before any commitment is made. Where a market is added later, the review is repeated for that market, because protection that exists in one region does not travel.
